RELEASE FOR PARTICIPATION IN THE 2009 BEST BUDDIES' MIDNIGHT MADNESS GENERAL RELEASE OF LIABILITY PLEASE READ THIS CAREFULLY. It affects any rights you may have if you (or your child) are injured or otherwise suffer damages while voluntarily participating in the 2009 Best Buddies' Midnight Madness. I understand that the 2009 Best Buddies' Midnight Madness is a 12-hour event in which I will be asked to participate in an event that may involve physical activity, such as, but not limited to, walking and running. I understand there are inherent dangers associated with these activities. The activities may include fatigue, muscle soreness, shortness of breath, and personal injury or even death. I declare that I am physically fit to complete this event and I am in possession of all necessary medical proof to support this oath and therefore take part in this event under my own responsibility. I authorize any medical personnel to intervene on my behalf according to his or her competence if deemed necessary. I assume full responsibility for any risk of loss, property damage, or personal injury that may be sustained by me, or any loss or damage to property owned by me as a result of participation in the 2009 Best Buddies Midnight Madness. I agree to follow all safety rules established for the 2009 Best Buddies' Midnight Madness and further agree to refrain from conduct that creates risk for other participants. I hereby, RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the State of YOUR STATE, the Board of Regents of the State of YOUR STATE, YOUR UNIVERSITY, and Best Buddies International, and any of the officers, servants, agents and employees of the above-mentioned entities (hereinafter referred to as RELEASEES) for any liability, claim and/or cause of action arising out of or related to any loss, damage, or injury, including death, that occurs as a result of participation in the 2009 Best Buddies' Midnight Madness. I agree TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES whether injury or damages is caused by my negligence, the negligence of the RELEASEES or the negligence of any third party. I further agree that this Release and Hold Harmless Agreement shall bind the members of my family and spouse, and my heirs, assigns, and personal representative (if any), and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Release and hold Harmless Agreement shall be construed in accordance with the laws of the State of Rhode Island.
